Terms of Service

Please read these Terms of Service carefully before using the Gym Machines website or placing an order. By using this website you agree to be bound by these terms.

1. About us

Gym Machines is a South African supplier of home, studio and commercial gym equipment, trading online at gymmachines.co.za. Our registered address is 134 Kempston Road, Gqeberha, Eastern Cape, 6020. You can reach us at info@gymmachines.co.za.

2. Orders and acceptance

Placing an order is an offer to purchase. We reserve the right to accept or decline any order. You will receive an order confirmation email when your order is placed; your order is confirmed only once payment has been successfully processed and you have received a dispatch notification.

3. Pricing

All prices are shown in South African Rand (ZAR) and include VAT where applicable. We reserve the right to change prices at any time without prior notice. The price that applies to your order is the price displayed at checkout.

We take care to price everything correctly, but errors happen. If an item is listed at an obviously incorrect price, we will contact you before dispatch and you may either confirm the order at the correct price or cancel it for a full refund.

4. Payment

We accept the major South African payment methods offered at checkout. Payment must be made in full at checkout. Payments are handled by secure third-party payment processors; we do not see or store your card details.

5. Stock availability

Stock levels change constantly and listings can occasionally sell out between an order being placed and being picked. If an item you have ordered is unavailable, we will contact you promptly to offer an alternative, a backorder, or a full refund. The choice is yours.

6. Delivery

We offer free nationwide delivery across South Africa. Delivery timeframes are estimates and are not guaranteed. Large and heavy equipment is delivered by a dedicated freight service on a longer lead time. See our Shipping & Delivery Policy for full details.

7. Returns and refunds

Returns are governed by our Returns & Refund Policy, which forms part of these terms.

8. Product information

We make every effort to ensure that descriptions, images, dimensions and specifications are accurate. Minor variations in finish, colour and specification can occur between production batches, and manufacturers change specifications without notice. Images are illustrative and accessories shown are not included unless the listing says so. If a product you receive differs materially from its description, contact us immediately.

9. Assembly, installation and safe use

Unless a listing states otherwise, equipment is supplied without assembly or installation. You are responsible for assembling equipment according to the manufacturer's instructions, for anchoring or bolting down anything that requires it, and for ensuring the floor and space are suitable for the equipment and the loads involved.

Training with weights and machines carries inherent risk. Equipment must be used for its intended purpose, within its stated user and load limits, and inspected regularly. If you are new to training or have a medical condition, seek qualified advice before starting.

10. Warranty

Products are covered by the manufacturer's warranty where one applies, and the terms vary by brand and by whether equipment is home or commercial rated. Where a listing states warranty cover, that is the cover that applies. Warranty claims are directed to the manufacturer, and we will assist you with lodging and following up a claim wherever we can. Warranties generally exclude normal wear, consumable parts, and damage caused by incorrect assembly, overloading, commercial use of home-rated equipment, or lack of maintenance.

11. Consumer protection

Your rights under the Consumer Protection Act, 68 of 2008 are not limited by these terms. Where there is any conflict between these terms and that Act, the Act prevails.

12. Limitation of liability

To the fullest extent permitted by law, Gym Machines is not liable for any indirect or consequential loss arising from the use of this website or of equipment purchased from us, including loss of profit or loss of use. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability under the Consumer Protection Act.

13. Intellectual property

All content on this website, including text, images, logos and layout, belongs to Gym Machines or its suppliers and may not be reproduced without permission.

14. Privacy

Your personal information is handled in accordance with our Privacy Policy.

15. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.

16. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.
